The display of products on our website or elsewhere is an invitation for you to make an offer to buy, which you do by submitting an order for a product by sending an email to info@clairegaudion.com or by messaging us via our contact page. We will acknowledge receipt of your order, and communicate with you about your order, by email.

You are responsible for ensuring that any order you place is correct, accurate and includes all necessary information. We cannot be held responsible for any errors made when placing an order, and may accept or decline all or part of your order for any reason and at any time before despatch. We only process and store your personal information in order to honour our obligations under these terms, your information will not be used for any other purpose. Please see our Privacy Notice for further information about how we treat your data.

All prices are in GBP and are inclusive of any applicable VAT and exclusive of any delivery charges, unless stated otherwise. Payment must be made in full for all products at the time of placing your order, using our online payment system (on receipt of an invoice), or by bank transfer.

We are reliant on third parties to supply our products therefore any product is subject to availability and may be withdrawn at any time. As soon as possible, but in any event within the applicable delivery time frame given on the relevant product page, we will send you a shipping confirmation email that will constitute our acceptance of your order and state the anticipated shipping date with tracking information, if applicable. If any ordered product is unavailable, we will endeavour to inform you as soon as possible and you will be entitled to a full refund.

You agree that the point of sale for all of our products is deemed to be at our registered address.

Please note that our products are designed and sold for light domestic residential use only. We can give no guarantee as to the suitability of any product for a particular purpose, it is the customer’s responsibility to ensure that the products are suitable for their intended use prior to ordering. Please ensure that you read and follow our Rug Guide where applicable.

We endeavour to ensure that our products on the website are displayed as accurately as possible. However, colours may vary between products and computer displays, so we are unable to guarantee the precise colour of the product you receive. If you request a product sample or colour swatch, please be aware that there may still be some variations between batches.

All quoted sizes are approximate and for guidance only. Please check before ordering that you have enough room for your product, and the space to manoeuvre the product through your house.

We may make changes such as minor design or technical changes to a product, or changes in raw materials, at any time without notice, and you may not reject any product due to such changes as long as they do not reasonably affect use or enjoyment of the product.

Where an ex-display item is sold, it may have minor imperfections, and is sold expressly subject to this fact so may not be rejected for this reason.

Cancellation Rights

You have the statutory right under the Consumer Contracts Regulations 2013 to change your mind and cancel your order at any time up to 14 days after the day you receive your product (“Cooling-off Period”). After this time, your product cannot be returned or cancelled, except if it is faulty. The Cooling-off Period does not apply to any Custom Item. Please note that all our rugs are Custom Items.

If you do want to cancel your order, you must contact us in writing (preferably by email at info@clairegaudion.com) during the Cooling-off Period stating as a minimum your order number and your wish to cancel, so that we can provide you with the correct return shipping address. Please note that our registered office cannot accept all returned products, so if you do send a product to this address, without prior authorisation, then we will be entitled to refuse to accept delivery. You remain responsible for arranging, and the cost of, the safe return of the product to us. We may, at our discretion, offer to arrange collection of the product at your cost.

You must return the product back to us within 14 days of the end of the Cooling-off Period. You are the owner of the product once delivery has been made, and must take good care to ensure that it arrives back with us in ‘as new’ condition, unused and undamaged. If you have opened/unwrapped the product, you must re-package it again carefully to ensure that it is protected during transport.

If you comply with your legal obligations, we will refund the price of the returned product together with any standard delivery charges that were paid by you (but not where you chose a special or faster delivery method). We are permitted by law to reduce your refund to reflect any reduction in the value of the product if it is not received back in the same condition as when delivered to you.

When submitting your order, it is your responsibility to make sure that all measurements and requirements are accurate and complete. You accept that we have no liability for errors or defaults in a Custom Item where we are not at fault, and a Custom Item cannot be returned or refunded if it does not meet your expectations or you are dissatisfied with your choices.

Once your order for a Custom Item is accepted, you will not be entitled to cancel or make any changes to it. However, if you have made a mistake or change your mind before we have started manufacture, we use our reasonable endeavours to cancel the order or incorporate any changes, but this is not guaranteed and is at our sole discretion. Where changes are possible, we will ask you to confirm any change to the price, delivery, or anything else before going ahead.

Any refunds will only be made back to the original method of payment.

We warrant that for a 12 month warranty period from delivery all products will be free from material defects in design, materials and workmanship. We will not be liable for any fault arising due to alteration, fair wear and tear, damage, or misuse of an item.

We are entitled to address all notices and communication to you via the email and/or billing address/phone number provided with your order.

These Terms are governed by English law, and you agree that the English courts shall have exclusive jurisdiction over all claims and disputes.

Nothing in these Terms will exclude or limit our liability for (i) fraud or other criminal act, (ii) personal injury or death caused by our negligence, or (iii) any other liability that cannot be excluded by law, and nothing in these Terms will operate as to reduce your rights as a consumer.

To the extent permitted by applicable law, we will not be liable to you for any indirect or consequential loss, damage or expenses (including loss of use, profits, business or goodwill) howsoever arising out of, or in connection with, any fault with a product, and in no event will we have any liability to pay any compensation other than to refund the purchase price (and shipping costs where applicable) of the relevant product.
